Terms of Service
These Terms of Service ("Terms") govern your access to and use of Nuralm's app and website at nuralm.bywillo.ai (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use Nuralm.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you are at least 13 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Nuralm is a guided meditation, mindfulness, and mental wellness app. The Service provides personalized audio sessions including guided meditations, breathing exercises, sleep audio, mantras, affirmations, manifestation content, and ambient soundscapes. The Service is intended for personal, non-commercial wellness use.
Not a substitute for professional care. Nuralm is a wellness tool, not a medical device, mental health treatment, or substitute for professional psychiatric, psychological, or medical advice, diagnosis, or treatment. If you are experiencing a mental health crisis, please contact a qualified professional or call 988 (Suicide & Crisis Lifeline) immediately.
3. Accounts
To access most features, you must create an account using your email address. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us promptly at support@nuralm.com if you suspect unauthorized access
You may not share your account with others or create accounts for anyone other than yourself without our express permission.
4. Subscriptions and Payments
Free trial
We may offer a free trial period. At the end of the trial, your subscription will automatically renew at the applicable subscription rate unless you cancel before the trial ends.
Subscription plans
Paid subscriptions are billed in advance on a monthly or annual basis. All prices are in US dollars. Prices may change with 30 days' advance notice.
Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not provide prorated refunds for the unused portion of a billing period.
Refunds
All purchases are final. Except where required by law, we do not offer refunds. If you believe you were charged in error, contact us at support@nuralm.com within 30 days of the charge.
Payment processing
Payments are processed by Stripe. By making a purchase, you also agree to Stripe's terms of service. We do not store your full payment card details.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Scrape, copy, or redistribute any audio content, text, or other materials from the Service
- Use automated tools, bots, or scripts to access the Service
- Circumvent, disable, or interfere with security features of the Service
- Upload or transmit viruses, malware, or any other harmful code
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Use the Service to harm, harass, or exploit others
We reserve the right to suspend or terminate your account for violations of these rules.
6. Intellectual Property
All content in the Service — including audio sessions, guided meditations, scripts, music, soundscapes, branding, and software — is owned by or licensed to Nuralm and protected by US copyright, trademark, and other intellectual property laws.
Your subscription grants you a limited, personal, non-transferable, non-sublicensable license to access and use the content for your own personal wellness purposes. No content may be downloaded, recorded, redistributed, or used outside the Service without our written permission.
7. User Content
If you submit feedback, suggestions, or other content to us, you grant Nuralm a worldwide, royalty-free, perpetual license to use, reproduce, and incorporate that content to improve the Service, without compensation to you. We will not identify you publicly in connection with your feedback without your permission.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Third-Party Links and Services
The Service may contain links to third-party websites or integrate with third-party services (such as payment processors). We are not responsible for the content, privacy practices, or terms of those third parties. Your use of third-party services is at your own risk.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NURALM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold harmless Nuralm and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the United States and the state in which Nuralm is incorporated, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to a jury trial or to participate in a class-action lawsuit.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, for material changes, notify you by email or in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for violations of these Terms or for any other reason at our discretion. You may stop using the Service and close your account at any time. Sections 6 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 13 (Governing Law) survive termination.
